The MLO Minute: Free Special Education Consultations and Contingent Fees Provide Families Access To MLO Services
In 1986, Congress passed, and President Reagan signed into law, amendments to the federal special education law (IDEA) which provides that parents who prevail in a special education case are entitled to payment of reasonable counsel fees. This provision is critical to families, as it allows our firm to offer free special education consultations in virtually all cases, and in the majority of our cases to handle the matter on a contingency basis where the family does not pay hourly fees as the case proceeds. Rather, MLO frequently takes the risk of prevailing in our cases, which reflects our confidence in the abilities of our attorneys. And in those cases where we cannot assume the full financial risk of prevailing, we often accept a significant portion of the risk of prevailing.
MLO is unique in offering such extensive, skilled, and comprehensive access to families in the special education due process/court systems. We are able to do so because of the comprehensive skills and experience of our attorneys in all areas of special education. Our attorneys are licensed in six jurisdictions, with our most active caseloads currently being in Pennsylvania and Delaware. Collectively, we are the most comprehensive special education law firm in the United States, we handle every type of special education matter, and our attorneys possess well over a century of special education experience. We remain on the cutting edge of legal and educational changes through constant research, continuing legal education, staff training with respected outside educational professionals, and constant reviews of major judicial decisions.
