Moving from a Latin American country to the United States brings many risks, but families do so looking for opportunities and benefits for their children.  At times, your child may have a diagnosis identified in their country of origin.  Parents take these medical and educational records to their child’s new schools in the United States asking for help. But what can a parent do if American schools reject these important documents because they are written in Spanish? Under the IDEA, it is not acceptable for the new school say, “No thank you, we cannot read evaluations or educational records written in Spanish.”

The IDEA requires schools to consider your child’s evaluations, including evaluations performed in other countries, or by other school districts, hospitals or private doctors.  If your child was identified as eligible to receive special education services in their previous school, the new school district is required to provide the student with comparable services as had appeared in their previous IEP.  When evaluations are written in another language such as Spanish, the rights of the child are not diluted. The new school district must find a way to translate the information – especially of a special education program in an IEP – so that the district can offer comparable services.  If translation is not possible, the district is required to conduct its own evaluation as soon as possible and provide an appropriate program. Remember, expecting your child to learn a new language, which can take at least three to five years, is never an excuse to delay an evaluation or offer of appropriate special education services.

If your new school district refuses to accept these important documents, there are steps parents can take to get a special education program:

1. When you register your child in the new school district, indicate on the registration form that your child has special education needs. If the form does not ask for this information,  the parent should hand write directly on the registration document that the child has special education needs;

 

2. In addition, provide a letter, along with copies of all medical and educational records, to the supervisor of special education in the new school district.  On the letter, be sure to always include the date that the letter and documents were provided to the school district and to list the documents submitted.  It is acceptable to write this letter in Spanish if you cannot find someone to help write it in English;

 

3. If the school district does not communicate with you regarding any documents that you provided to the supervisor of special education, invite you to a meeting, or offer your child special education services in an IEP, send the supervisor of special education a second letter requesting a meeting with the supervisor and the director of special education. Be sure to include the date on your letter.  You should also request a special education evaluation of your child under the IDEA;

 

4. If the district does not respond to your letters, seek help from a parent liaison, an advocate, or lawyer.

Remember, to put all requests in writing, as they will not be forgotten and may receive more attention.  Always keep copies of all notices and letters with dates that they were provided to the school district, as it will be useful if there is a dispute in the future that cannot be resolved without litigation.

 

 

Cambiando de un país latinoamericano a los estados unidos trae muchos riesgos, pero familias lo hacen buscando nueva oportunidades y beneficios para sus hijos. A veces, su hijo tiene algún diagnóstico identificado en su país de origen y sus padres llevan esos documentos médicos y educativos a las escuelas en los estados unidos. Pero, ¿qué se puede hacer si las escuelas Americanas rechazan esos archivos porque están escritos en español? Bajo la ley IDEA, no es aceptable que la escuela nueva diga, “No gracias, no podemos leer evaluaciones o documentos de su hijo escritos en español.”

La ley IDEA requiere que escuelas consideren evaluaciones realizadas sobre sus hijos, sean de otros países, distritos escolares, hospitales, o doctores privados. Además, si su hijo fué identificado de estar en necesidad de educación especial por su escuela previa, el distrito nuevo debe de continuar el mismo programa y servicios en la mayor medida posible. Cuando evaluaciones están escritas en otro idioma, como español, los derechos de sus hijo no se diluyen. El distrito nuevo debe de encontrar una forma de traducir la información – especialmente de un programa de educación especial.  Si traducción no es posible, el distrito está requerido de realizar su propia evaluación lo más pronto posible y ofrecer un programa apropiado.  Recuerden, esperando que su hijo aprenda un idioma nuevo, que puede demorar por lo menos tres a cinco años, nunca es una excusa para aguantar ofreciendo una evaluación o educación apropiada.

Si su distrito rechaza estos documentos importantes, hay pasos que padres pueden tomar para obtener un programa de educación especial:

1. Cuando registra a su hijo en el distrito nuevo, escriba en el documento de registro que su hijo tiene necesidades de educación especial, a veces el formulario de registro les pregunta esta información;

 

2. Además entregue copias de todo documentos médicos y educativos al supervisor de educación especial con una carta, incluyendo la fecha, y una lista de los documentos entregados.  Es aceptable escribir esta carta en español si no puede encontrar alguien que los ayude escribirla en inglés;

 

3. Si el distrito no communica con Ud. sobre los documentos, invitarlos a una reunión, o para ofrecer servicios de educación especial, escriba otra carta, incluyendo la fecha, pidiendo una reunión con el director de educación especial y pida una evaluación de su hijo bajo la ley IDEA;

 

4. Si el distrito continúa ignorando sus cartas, busque ayuda de un enlace de padres o abogado.

Siempre mantenga copias de todas notificaciones y cartas, con las fechas, ya que serán útil si hay un problema que no se puede resolver sin litigio.  Se sugiere poner todas solicitudes en escrito porque atraerá más atención.
