Special Education Hearing Officer
NORTHEASTERN, PA, July 15th, 2015: McAndrews Law Offices, P.C., a firm that focuses its practice on special education and advocating for children with disabilities with offices in Scranton and the Philadelphia region, recently succeeded in a case regarding a student and their right to educational services. Special Education Hearing Officer awarded compensatory education to a student with significant social, emotional, and behavioral needs, despite that the student was achieving academic progress. Indeed, the Hearing Officer noted “that Student excelled academically over the course of the school year is truly remarkable, but that success must be largely attributed to Student’s own motivation and strengths rather than to the provided accommodations.” The Hearing Officer concluded that the District violated its Child Find duties and denied the student a free appropriate public education by failing to evaluate the student pursuant to the IDEA and failing to develop an educational program that addressed the student’s social, emotional, and behavioral needs, which included the teaching of skills that the student lacked.
